UK to Align Itself with the GDPR Despite Brexit

“A new law will ensure that the United Kingdom retains its world-class regime protecting personal data”. This is today’s strong statement by Her Majesty The Queen reflecting the level of priority given by the UK government to privacy and data protection. Aside from the political controversies surrounding the recent general Election and the prospect of Brexit, the Queen has confirmed that during this Parliament the government intends to pass a new Data Protection Act replacing the existing one.

Hogan Lovells Launches GDPRnow App

Exactly one year before the EU General Data Protection Regulation becomes applicable, global law firm Hogan Lovells has launched GDPRnow, a mobile application that provides companies with assistance to identify practical steps to comply with the new framework. Conceived entirely in-house by the firm’s Privacy and Cybersecurity team, GDPRnow is the first app ever aimed at generating a GDPR compliance action plan specific to an individual business’s activities.

Will The Consent Collected Before GDPR Still Be Valid?

The “Guide on the Application of the European Personal Data Protection Regulation” published by the Italian DPA states, in the “Recommendations” at the foot of the consensus form, that: “The consent obtained before May 25, 2018 remains valid if it has all of the above characteristics.

Belgian DPA Issues Recommendation on DPO Appointment under GDPR

Recently, the Belgian Privacy Commission (the “Belgian DPA”) released a Recommendation (in French and Dutch) regarding the requirement to appoint a data protection officer (“DPO”) under the EU General Data Protection Regulation (“GDPR”).

The Recommendation aims to provide guidance in response to the many questions that the Belgian DPA has received so far regarding the DPO function, in particular regarding the compatibility of the DPO function with other existing functions within a company (e.g., security officer, compliance officer, risk manager, human resources director, IT director).
